These Terms & Conditions ("Terms") govern your access to and use of our website and the purchase of products from our online store, operated by Empresa de Manufactura Tejada Pérez SRL ("Danselle," "we," "us," or "our"). By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website.

1. GENERAL CONDITIONS

By accessing, browsing, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Returns & Exchanges Policy, all of which are incorporated herein by reference.

We reserve the right to update, modify, or replace any part of these Terms at any time by posting the revised Terms on our website. It is your responsibility to review these Terms periodically. Your continued use of our website after any changes constitutes your acceptance of the revised Terms.

We reserve the right to refuse service to anyone for any reason at any time.

2. ELIGIBILITY

To use our website and make purchases, you must be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater. If you are under 18, you may use our website only with the involvement and consent of a parent or legal guardian. By placing an order, you represent and warrant that you meet these eligibility requirements.

3. PRODUCTS AND DESCRIPTIONS

We make every effort to display our products as accurately as possible, including colors, dimensions, and materials. However, because our products are handcrafted, slight variations in color, pattern, stitching, or embellishment placement may occur. These variations are inherent to the artisanal nature of our products and are not considered defects.

Additionally, the display of colors on your screen depends on your monitor settings and may not exactly reflect the actual color of the product. We cannot guarantee that your computer or device screen will accurately display the color of our products.

All product descriptions, including measurements, fabrics, and sizing guides, are provided for informational purposes. While we strive for accuracy, we do not warrant that product descriptions or other content on our website are error-free, complete, or current.

3.1 Handcrafted Product Disclaimer

All Danselle products are handmade with care and attention to detail. Due to the handcrafted nature of our products, each item is unique. Minor variations in stitching, embellishment placement, color shading, or finishing details are normal and reflect the artisanal craftsmanship of our products. Such variations do not constitute defects and are not grounds for return or exchange.

3.2 Custom Performance Costumes

Custom performance costumes are made to order based on the specifications, measurements, and design preferences you provide. It is your responsibility to provide accurate measurements and to review and confirm all design details before production begins. We offer a measurement guide and our team is available to assist you with the measurement process.

Once a custom order has been confirmed and production has begun, it cannot be cancelled, modified, returned, or refunded, except in cases of manufacturing defects (see Section 3.3 below).

3.3 Defective Products

A product is considered defective if it has a flaw in materials or workmanship that was present at the time of delivery, such as broken zippers, detached seams, missing embellishments, incorrect sizing (differing from ordered specifications), fabric tears, or significant color discrepancies from the product listing. Normal wear and tear, damage caused by improper use or care, and the natural variations inherent to handcrafted products are not considered defects.

4. PRICING AND PAYMENT

All prices displayed on our website are in United States Dollars (USD) and do not include applicable shipping costs, taxes, duties, or customs fees, which will be calculated and displayed at checkout.

We reserve the right to change prices at any time without prior notice. The price charged for a product will be the price in effect at the time the order is placed, regardless of any subsequent price changes.

In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price. If your order is cancelled due to a pricing error, we will notify you and issue a full refund.

4.1 Payment Methods

We accept payments through the following methods:

• Credit and debit cards (Visa, Mastercard, American Express, and other major cards) processed through Shopify Payments.

• PayPal.

• Shop Pay, Apple Pay, Google Pay, and other digital wallets available through Shopify Payments.

All payments are processed securely through our third-party payment processors. We do not store your full credit card information on our servers. By providing your payment information, you represent and warrant that you are authorized to use the payment method.

4.2 Currency

All transactions are processed in United States Dollars (USD). If your payment method is denominated in a different currency, your bank or payment provider may apply a currency conversion fee. We are not responsible for any additional fees charged by your bank or payment provider.

4.3 International Taxes, Duties, and Customs

For international orders, you are responsible for all applicable customs duties, import taxes, brokerage fees, and any other charges imposed by your country's customs authorities. These charges are not included in our product prices or shipping fees and are the sole responsibility of the buyer. We recommend contacting your local customs office for information on applicable duties and taxes before placing an order.

We are not responsible for delays caused by customs processing.

5. ORDERS

When you place an order through our website, you are making an offer to purchase the products in your order. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraudulent activity.

You will receive an order confirmation email after placing your order. This confirmation does not constitute acceptance of your order; it simply confirms that we have received your order. Acceptance of your order occurs when we ship the product(s) to you.

We reserve the right to limit the quantities of any product or to discontinue any product without prior notice.

6. SHIPPING

Shipping times and costs vary depending on the destination and shipping method selected at checkout.

6.1 Processing Time

Standard catalog items (leotards, tights, training wear, and accessories) are typically processed and shipped within  five to seven (5-7) business days after payment confirmation.

Custom performance costumes require additional production time. Estimated production timelines are provided at the time of order and may vary depending on design complexity and current order volume. We will communicate any significant delays promptly.

6.2 Shipping Costs

Shipping costs are calculated at checkout based on the destination, weight, and dimensions of your order and the shipping method selected. We may offer free or discounted shipping promotions from time to time, subject to specific terms and conditions.

6.3 Risk of Loss

All items purchased from our website are shipped pursuant to a shipment contract. The risk of loss and title for items pass to you upon delivery of the items to the shipping carrier.

6.4 Lost or Damaged Shipments

If your order arrives damaged or does not arrive at all, please contact us within seven (7) days of the expected delivery date. We will work with the shipping carrier to investigate and resolve the issue. We may require photographs of damaged products and packaging.

7. INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, graphics, logos, images, product photographs, product designs, costume designs, patterns, and the overall look and feel of the website, is the property of Danselle or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent, except for your personal, non-commercial use.

The Danselle name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Empresa de Manufactura Tejada Pérez SRL. You may not use these marks without our prior written permission.

8. USER CONTENT

If you submit content to our website, such as product reviews, photographs, or comments (collectively, "User Content"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content worldwide in any media.

You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, and that use of your User Content does not violate these Terms or any applicable law and will not cause injury to any person or entity.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the website shall be resolved through good-faith negotiation. If the parties are unable to resolve the dispute through negotiation, the dispute shall be submitted to the competent courts of the Dominican Republic.

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

If any provision of these Terms is held to be unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the other provisions will remain in full force and effect.
