Welcome to Danselle. These Terms & Conditions ("Terms") govern your access to and use of our website and the purchase of products from our online store, operated by Empresa de Manufactura Tejada Pérez SRL ("Danselle," "we," or "our"). By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website.

1. GENERAL CONDITIONS

By accessing, browsing, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and our Returns & Exchanges Policy, all of which are incorporated by reference.

We reserve the right to update, modify, or replace any part of these Terms at any time by posting the revised Terms on our website. It is your responsibility to review them periodically. Your continued use of the site after any changes constitutes your acceptance of the revised Terms. The version published at the time you place your order is the version that governs that order.

We reserve the right to refuse service to anyone, for any reason, at any time.

2. ELIGIBILITY

To use our website and make purchases, you must be at least eighteen (18) years old or the age of majority in your jurisdiction, whichever is greater. Our garments are made for dancers of all ages, including girls, but the purchase must be made by an adult. If you are under 18, you may use our website only with the involvement and consent of a parent or legal guardian. By placing an order, you represent and warrant that you meet these requirements.

3. PRODUCTS AND DESCRIPTIONS

We make every effort to display our products as accurately as possible, including colors, dimensions, and materials. However, because our products are handcrafted, slight variations in color, pattern, stitching, or trim placement may occur. These variations are inherent to the artisanal nature of our products and are not considered defects.

Additionally, how colors display on your screen depends on your monitor settings and may not exactly reflect the actual color of the product. We cannot guarantee that your computer or device screen will accurately display the color of our products.

All product descriptions, including measurements, fabrics, and size guides, are provided for informational purposes. While we strive for accuracy, we do not warrant that product descriptions or other content on our website are error-free, complete, or current. We do not guarantee that a garment will meet the dress code, syllabus, or exam requirements of a particular academy or competition; please verify requirements with your academy before purchasing.

3.1 Handcrafted Product Notice

All Danselle products are handmade with care and attention to detail. Because of their artisanal nature, each piece is unique. Minor variations in stitching, trim placement, color shade, or finishing details are normal and reflect the craftsmanship of our products. Such variations do not constitute defects.

3.2 All Sales Are Final

All Danselle products are sold as final sale. Because leotards, skirted leotards, tutus, and fitted dancewear are intimate, close-to-body apparel that cannot be hygienically returned to inventory, we do not accept returns, exchanges, size changes, or store credit for reasons of fit, preference, or change of mind.

We do repair, replace, or refund items with a confirmed manufacturing defect, items shipped in error, missing items, and items damaged in transit, within the timeframes set out in our Returns & Exchanges Policy, which forms part of these Terms. By placing an order, you confirm that you have read and accepted that policy.

3.3 Custom Costumes

Custom costumes are made to order based on the specifications, measurements, and design preferences you provide. It is your responsibility to provide accurate measurements and to review and confirm all design details before production begins. We offer a measuring guide and our team is available to assist you with the measuring process.

Once a custom order has been confirmed and production has begun, it cannot be cancelled, modified, returned, or refunded, except in cases of manufacturing defects or a deviation from the specification sheet you approved in writing.

3.4 Defective Products

A product is considered defective if it has a flaw in materials or workmanship present at the time of delivery, such as broken snaps or closures, detached seams, faulty elastic, missing trims, fabric tears, lining defects, incorrect size different from what was ordered, or significant color discrepancies from the product listing. Normal wear and tear, damage caused by improper use or care, and natural variations inherent to handcrafted products are not considered defects.

3.5 Garment Care

Our garments are made from lycra, spandex, and stretch fabrics, and require hand washing in cold water with mild soap, no bleach, no fabric softener, no wringing, and drying flat in the shade. Damage resulting from care that departs from the instructions on the garment’s label is not covered under any circumstance.

4. PRICING AND PAYMENT

All prices shown on our website are expressed in US Dollars (USD) or Dominican Pesos (DOP) and include ITBIS where applicable under Dominican law. Shipping costs are calculated and shown at checkout.

We reserve the right to change prices at any time without prior notice. The price charged for a product will be the price in effect at the time the order is placed, regardless of subsequent changes.

In the event of a pricing error, we reserve the right to cancel any order placed at the incorrect price. If your order is cancelled due to a pricing error, we will notify you and issue a full refund.

4.1 Payment Methods

We accept payment through the following methods:

  • Credit and debit cards (Visa, Mastercard, American Express, and other major cards) processed through Shopify Payments or another electronic payment service.

  • PayPal.

  • Shop Pay, Apple Pay, Google Pay, and other digital wallets.

  • All payments are processed securely through our third-party processors. We do not store your full card information on our servers. By providing your payment information, you represent and warrant that you are authorized to use that payment method.

4.2 Currency

All transactions are processed in US Dollars (USD) or Dominican Pesos (DOP). If your payment method is denominated in a different currency, your bank or payment provider may apply a conversion fee. We are not responsible for any additional fees charged by your bank or payment provider.

5. ORDERS

When you place an order through our website, you are making an offer to purchase the included products. We reserve the right to accept or decline your order for any reason, including product availability, pricing or information errors, suspected fraudulent activity, intent to resell, or a delivery address we cannot service.

You will receive a confirmation email after placing your order. This confirmation does not constitute acceptance of your order; it simply confirms that we have received it. Acceptance of your order occurs when we ship the product(s) to you.

We reserve the right to limit quantities of any product or to discontinue any product without prior notice.

6. SHIPPING

6.1 Shipping Destinations

We currently ship only within the Dominican Republic, to all provinces of the national territory. International shipping is not available at our online checkout; large international orders are accepted only by special quotation, under the conditions set out in our Shipping Policy.

6.2 Processing Time

Catalog items — leotards, skirted leotards, skirts, tutus, and hair accessories — are typically processed and shipped within three to seven (3–7) business days after payment is confirmed.

Custom costumes require additional production time. Estimated timelines are provided at the time of order and may vary depending on design complexity and workload. We will promptly communicate any significant delays.

6.3 Shipping Costs

Shipping costs are calculated at checkout based on the delivery province, weight, and dimensions of your order. Current rates and any free-shipping threshold are published in our Shipping Policy. We may occasionally offer free or discounted shipping promotions, subject to specific terms.

6.4 Risk of Loss

All items purchased on our site are shipped under a shipping and/or carriage contract. Risk of loss and title to the items pass to you upon delivery of the items to the courier. This does not affect your rights regarding items damaged in transit, which are addressed in our Returns & Exchanges Policy.

6.5 Lost or Damaged Shipments

If your order arrives damaged, contact us within seventy-two (72) hours of delivery. If your order does not arrive, contact us within seven (7) days of the estimated delivery date. We will work with the courier to investigate and resolve the issue. We may require photographs of the damaged products and packaging.

7. INTELLECTUAL PROPERTY

All content on this website, including without limitation text, graphics, logos, images, product photographs, product designs, costume designs, patterns, and the overall look and feel of the site, is the property of Danselle or its content suppliers and is protected under Dominican and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our website without our prior written consent, except for your personal, non-commercial use.

The Danselle® name, the La Casa de la Danza® mark, our logos, and all related names, logos, product and service names, designs, and slogans are trademarks of Empresa de Manufactura Tejada Pérez SRL®. You may not use these marks without our prior written permission.

8. USER CONTENT

If you submit content to our website or share content with us — such as product reviews, photographs, or comments — or if you tag us or use our hashtags on social media (collectively, "User Content"), you grant us a non-exclusive, royalty-free, worldwide, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that User Content in any medium, with credit to your username where possible.

You represent and warrant that you own or control all rights to the User Content you submit, that the content is accurate, and that you have the consent of every identifiable person appearing in it. Where a minor appears in the content, you represent that you are the minor’s parent or legal guardian, or that you have their written consent. You may request removal of your User Content at any time by writing to manufacturatejadaperez@gmail.com.

We reserve the right to remove any User Content at our sole discretion, for any reason, without notice.

9. PROHIBITED USES

You agree not to use our website:

  • For any unlawful purpose or to induce others to perform or participate in unlawful acts.

  • To violate any international, national, provincial, or local regulation, rule, law, or ordinance.

  • To infringe or violate our intellectual property rights or those of third parties.

  • To submit false or misleading information.

  • To upload or transmit viruses, malware, or any other type of malicious code.

  • To collect or track the personal information of third parties.

  • To interfere with or circumvent the website’s security features.

  • To use automated means, including bots, scrapers, or spiders, to access the site or collect information from it.

  • To attempt to gain unauthorized access to any part of the site, other accounts, computer systems, or networks.

10. DISCLAIMER OF WARRANTIES

OUR WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO THE WEBSITE AND ITS USE. NOTHING IN THIS SECTION LIMITS THE LEGAL WARRANTY APPLICABLE TO OUR PRODUCTS UNDER DOMINICAN CONSUMER PROTECTION LAW.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DANSELLE, EMPRESA DE MANUFACTURA TEJADA PÉREZ SRL, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, REPUTATION, OR MISSED PERFORMANCES, AUDITIONS, OR EXAMS, ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE WEBSITE, ANY PRODUCT PURCHASED THROUGH THE SITE, OR ANY CONTENT ON THE SITE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE OR PURCHASE OF PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM. NOTHING HEREIN LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Danselle, Empresa de Manufactura Tejada Pérez SRL, its officers, directors, employees, agents, and affiliates from and against any claim, damage, obligation, loss, liability, cost, or expense (including without limitation attorneys’ fees) arising from: (a) your use of and access to the website; (b) your breach of any term of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any claim that your User Content caused harm to a third party.

13. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including hurricanes and tropical storms, flooding, power or water outages, national strikes, port or customs disruptions, courier failures, fabric supply shortages, or acts of government.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the Dominican Republic, without regard to its conflict-of-law principles, including Law No. 358-05 on the General Protection of Consumer or User Rights and Law No. 126-02 on Electronic Commerce, Documents, and Digital Signatures.

Any dispute arising from or related to these Terms or your use of the website will be resolved through good-faith negotiation. If the parties are unable to resolve the dispute through negotiation, it will be submitted to the competent courts of the National District, Dominican Republic. Nothing in this section limits your right to file a complaint with Pro Consumidor (Instituto Nacional de Protección de los Derechos del Consumidor).

Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

15. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is held unenforceable or invalid, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Exchanges Policy, constitute the entire agreement between you and us regarding your use of the website and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
